Update:  While the August 22, 2013 attorney examiner entry granted DP&L’s motion to extend the deadline for filing objections, the attorney examiner also suspended the procedural schedule due to the number of motions to extend the deadline that have been filed in this case.  DP&L must file a status update with the PUCO on September 6, 2013.  At that time, if the parties still need more time for settlement negotiations or a new hearing date, the existing hearing date of September 26, 2013 will commence as scheduled, at which time the attorney examiner will call and continue the hearing.

Counsel continues to participate in ongoing settlement discussions.  DP&L remains optimistic that it will resolve many, if not all, issues in this case.  We will continue to participate in settlement discussions and will provide updates accordingly.
