Update:  On August 27, 2012, the PUCO Legal Director issued an entry denying certification of the joint interlocutory appeal filed last week by The Sierra Club, Ohio Environmental Council, Natural Resources Defense Council, and Environmental Law & Policy Center (“Appellants”).  The Director found it unproven that the 45-day objection period will lead to inferior portfolio plans, thus, the Appellants failed to satisfy the requirement of a new or novel question or interpretation, law, or policy.  We recommend that the OMAEG intervene in this case and participate in the proceedings, beginning with the September 6, 2012 Technical Conference at the PUCO at 10:00 a.m.
