Update: On July 31, 2015, AEP filed a memorandum contra the Office of the Ohio Consumers’ Counsel’s (OCC) motion to compel the production of information pertaining to AEP’s revenues collected pursuant to the Retail Stability Rider (RSR) during the term of its second electric security plan. In its memorandum contra, AEP argues that the discovery sought by OCC pertaining to AEP’s RSR revenues is not relevant or appropriate because the capacity deferral balance that it recovered through the RSR will be audited in another proceeding, and that its RSR revenues have no bearing upon the double recovery issue being examined by the Commission in the instant cases because the capacity deferral balance is only one component of the RSR and collected revenues do not relate directly or exclusively to capacity deferrals.
