Update: The U.S. Supreme Court heard oral arguments on the legality of a Maryland Public Service Commission plan to boost in-state generating capacity. Lower courts struck the plan down as unlawfully intruding on FERC’s exclusive jurisdiction to oversee the wholesale power markets. According to some commentators, advocates of the plan received a chilly reception from the justices during oral arguments. A decision is expected in the spring.
