Update: On January 26, 2015, FirstEnergy filed a memorandum contra the applications for rehearing filed by OMA Energy Group, the Environmental Law and Policy Center, Sierra Club, Natural Resources Defense Council, and Ohio Environmental Council the Commission’s December 17, 2014 finding and order adopting rules governing the disclosure of costs relating to electric distribution utilities’ (EDU) compliance with energy efficiency (EE) and peak demand reduction (PDR) benchmarks on customer bills. Further, in its memorandum contra, FirstEnergy was supportive of the applications for rehearing filed by the Retail Energy Supply Association and The Dayton Power and Light Company urging the Commission to reverse its order and instead of requiring CRES suppliers to send to EDUs their cost of compliance with the benchmarks, permit an EDU to utilize the EDU’s cost of compliance with the benchmarks on consolidated bills.
