Update: The PUCO denied OMAEG’s request to reject FirstEnergy’s tariff filing to implement the distribution modernization rider (DMR), which took effect January 1, 2017. OMAEG argued that FirstEnergy has not shown any progress towards improving the grid as required by the PUCO’s order approving the DMR. OMAEG also argued that the PUCO should postpone any implementation of the DMR until all appeals could be had, as a refund of collected fees would likely not be allowed, or in the alternative, make the DMR collection subject to refund if later found unlawful. Requests for reconsideration of the PUCO’s approval of the DMR itself are still pending with the PUCO.
