Update: IEU-Ohio filed a supplemental memorandum explaining that DP&L’s request to implement the Service Stability Extension Rider (SSR-E) should be denied in light of the Ohio Supreme Court’s recent decision which reversed the PUCO’s approval of DP&L’s Service Stability Rider (SSR). The Court’s reversal of the SSR rested on its decision involving AEP from a few months ago where it found that the PUCO erred in authorizing AEP to collect the equivalent of transition revenue through a charge that was similar to DP&L’s SSR. Parties have argued that the SSR-E cannot be implemented because, among other things, it would violate the prohibition against recovering the equivalent of transition revenue.
