Update: On July 2, 2013, the PUCO issued an entry resolving the dispute between AEP-Ohio and First Energy Solutions (“FES”) regarding rules that govern what FES must do to serve customers in AEP-Ohio’s territory. The PUCO’s entry grants AEP-Ohio’s alternate request for a limited waiver of the customer switching provisions contained in Section 31, Subsection 4 of its supplier tariff. In the event of a CRES provider non-delivery default, AEP-Ohio will be allowed to return all affected customers to its standard service offer within 15 calendar days. This waiver will extend to all AEP-Ohio’s competitors, not just FES. The OMAEG need take no position or action regarding this case; however, Counsel will continue to monitor.
