Update: In April, OCC filed a motion requesting that the PUCO stay the continued collection of the Rate Stability Charge (RSC) during the pendency of the appeal to the Supreme Court of Ohio. In denying OCC’s motion, the PUCO found that pursuant to Ohio law, once an order is appealed to the Court, the PUCO lacks authority to grant a motion to stay that order. Here, because OCC, OMAEG, and others have appealed the PUCO’s order continuing the RSC, the PUCO concluded that it no longer has authority to stay collection under the RSC.
