Update: The PUCO denied a request made by the Office of the Ohio Consumers’ Counsel (OCC) and others to reconsider its decision directing that FirstEnergy file tariffs to implement the modified and approved fourth electric security plan. OCC argued that FirstEnergy should not have been authorized to file tariffs in light of FERC’s ruling which held that no sales could be transacted under the Affiliate PPA unless and until it is approved by FERC.
OMAEG and other opponents filed a request to extend the procedural schedule involving FirstEnergy’s modified Rider RRS proposal. The PUCO set the matter for a hearing in July. But opponents argued that a July hearing date was far too aggressive considering that FirstEnergy has raised an entirely new proposal accompanied by new testimony. Opponents also raised concerns regarding expert witness availability given the expedited schedule. To protect their due process rights and allow adequate case preparation time, opponents asked that the hearing be extended to August. The PUCO has yet to rule on the request.
