Update: Duke filed a motion to strike the comments of OMA and Kroger which contend that Duke’s latest waiver request is in contravention of a prior PUCO order. In that prior order, the PUCO directed Duke to file its energy efficiency and peak demand reduction program portfolio plan (Plan) by June 15, 2016. Despite that order, Duke’s latest waiver request seeks to file the market study portion of the Plan by October 15, 2016. In Duke’s view, the comments of OMA and Kroger are procedurally improper; however, contrary to Duke’s assertion, the PUCO’s past practices allow comments of the type filed by OMA and Kroger.
