Update: Last year, the Office of the Ohio Consumers’ Counsel and Northwest Ohio Aggregation Coalition appealed a PUCO decision approving FirstEnergy’s Tariff to implement the Retail Rate Stability Rider. The PUCO and FirstEnergy moved to dismiss the appeal on grounds that it was premature because the PUCO’s decision was not yet final. The Supreme Court of Ohio agreed and dismissed the appeal.
