Update: This week’s evidentiary hearing has mostly consisted of intervenor witness testimony. Much of this testimony is in opposition to DP&L’s ESP proposal. On March 28, 2013, Dona Seger-Lawson, DP&L’s Director of Operations, testified regarding the transfer of DP&L’s generation assets, that DP&L’s reconciliation rider (administrative costs and certain riders that exceed a 10% threshold) should be non-bypassable, and that DP&L should be able to participate in its own auction. These are all arguments that she has previously made, so her testimony did not include any surprises.
The hearing is on track to conclude next Tuesday, April 2, 2013. At that time, the attorney examiners will provide the briefing schedule. The OMAEG will file a post-hearing brief opposing DP&L’s $137.5 million annual service stability rider (“SSR”) and will articulate the impact that it will have on manufacturers.
