Update: On February 27, 2015, the attorney examiner issued an entry denying the motion of the Environmental Law and Policy Center (ELPC) and the Ohio Environmental Council (OEC) in which the parties requested a determination that materials provided as part of the collaborative process are not confidential. The attorney examiner cited the fact that a categorical determination of the confidentiality of documents that have not been brought before the Commission for its examination regarding confidentiality is not possible under Ohio law in support of the determination. The attorney examiner did, however, deny a motion for protective order filed by ELPC and OEC in which the requested confidential treatment of certain collaborative materials which FirstEnergy contended were confidential at the time of the meeting.
