Update:  On May 12, 2014, Energy Professionals of Ohio (EPO) filed a reply to AEP Ohio’s memorandum contra EPO’s motion to intervene out of time.  EPO contends that it may have existed as a legal entity, but that entity had no ability to make decisions on behalf of its members until the pertinent intervention deadline had passed.  Further, EPO contends that extraordinary circumstances surrounding its intervention do, in fact, exist, and that those circumstances warrant its participation in the proceeding.

Further, On May 16, 2014, depositions of Pablo Vegas, President and Chief Operating Officer of AEP Ohio, and William Allen, Managing Director of Regulatory Case Management, commenced.  A number of other AEP Ohio witnesses are scheduled to be deposed by interested parties early next week.
