Update: A third notice of appeal was filed by the Ohio Consumer’s Counsel on May 23, 2013. The OCC appeal objects to PUCO’s August 8, 2012 Opinion and Order, and the two PUCO Entries on Rehearing, and specifically the retail stability rider charges and capacity costs (plus financing costs) that will be collected over the next five years. Although the focus of the appeal is the impact on residential customers, OMA Counsel will review the appeal and continue to monitor it for any potential collateral impact on manufacturers.
