Update:  On November 1, 2013, the OCC filed an application for rehearing which challenges the lack of consumer protections afforded by the Commission’s order granting Ormet’s application for a unique arrangement.  All memoranda contra to this application must be filed by November 12, 2013.

On November 7, 2013, OCC filed a letter stating that it was withdrawing the following assignments of error:  (1) that the Commission should have held that there are no delta revenues for customers to pay above the cap; (2) that the Commission erred in placing the burden of paying additional delta revenues upon AEP Ohio customers; (3) that the Commission erred by not deciding that the first priority of any above-tariff payments by Ormet should be for paying back customers; and (4) that the Commission erred in deciding that its objective for reimbursement to customers should be tied to future aluminum prices.  Although it withdrew the assignments of error enumerated above, OCC maintained the three other assignments of error asserted in its application for rehearing.
