Update:  FirstEnergy recently filed a motion for continuance, requesting that the PUCO modify the procedural schedule.  Specifically, rather than the case commencing in November as currently scheduled, FirstEnergy proposes the following dates: 1) January 23, 2013 – due date for FirstEnergy testimony; 2) January 31, 2013 – due date for intervenor testimony; 3) February 8, 2013 – due date for PUCO Staff testimony and date for prehearing conference; and, 4) February 19, 2013 – commencement of hearing date.  OEC and OCC are the only intervening parties that oppose this request.  Modifying the procedural schedule in this case will be most beneficial for intervening parties to attempt to obtain access to the non-redacted version of the management/performance audit, which evaluates FirstEnergy’s questionable actions in procuring renewable energy credits.  Accordingly, the PUCO should issue a decision within the next week.
